TERMS OF USE

These Terms of Use apply to all services which MARIN TRAVEL SLtd., 54 Matka Baštijana, 10000 Zagreb, Croatia (MT) provides to Users (each a User) of the site www.marintravel.hr (Site) and to services which Drivers (each a Driver) booked through the Site provide to Users, unless agreed otherwise between the User and the Driver. By using the Site, the User agrees to be bound by these Terms of Use and should there be any changes regarding the Conditions, the User is bound by the conditions that were in force at the time of booking, as far as the User is concerned and at the time of driving acceptance, as far as the Driver is concerned.

MT offers a ride-in service from the starting point to the destination, enabling the User to book the selected ride and pay for the transport service. The transport service is provided directly by the Driver as an independent service provider, who accepts the reservation by the User.

MT is a travel agency that deals with passenger transportation and acts as an intermediary through a platform, serving as a service for connecting passengers as a User with partner Carriers or partner Drivers.

Any potential damage, dispute, or misunderstanding that arises directly in the relationship between MT and the passengers as a User is the exclusive responsibility  of MT to resolve.

Any similar potential issue that arises in the relationship between partner Carriers or partner Drivers and the passengers as ac User, they must resolve it among themselves between them according to the rules set out in the business conditions description, and in such a case, MT will not bear any responsibility.

RESERVATION

The User makes a booking of the Transport Services through the Site by selecting place, date and time of departure as well as the destination.

You can complete your booking on-line by using the displayed booking form on MT website.

Just choose your desired starting point (country, city), the date, the time, your departure and destination points, when entering the address of the pick up, you have a „+“ sign with which you selected places for stops, and there can be multiple stops during the journey, or „-“ sign if you change your mind and want to delete that stop, and you choose how long time you want to stop at that place, you just have to take into account the total travel time with stops, which the systems adds up, the link will show you the type of vehicles and the prices of the transfer and follow the link, step by step as it guides you to confirm the reservation and pay for the transfer. Enter the required information and make your trip reservation. Can it be easier and more transparent ?

The price will includes a one-day transfer or journey from the starting point to the destination, with pre-arranged stops along the way, any extra options if you have selected, and all other travel expenses (tolls, fuel, etc.)

The quoted price is final and there are no additional fees for our services, MT will not charge any additional fees beyond the exact price that has been reserved and agreed upon in advance.

However, optional third party activities such as tours or attraction fees, such as various tickets are not included in the price.

When booking multi-day trips with the same driver and vehicle, you need to book each daily trip separately. In the ‘Extra options’ section, you must select ‘Driver overnight stay’ after each daily trip. If you fail to do so, we will consider the multi-day trip incorrectly booked, cancel the order, and send you a notification with the necessary changes to make the booking valid.

PAYMENT AND CANCELLATION RULES

The User will book the ride through the MT website using one of the following cards – MasterCard, Visa, Maestro, Amex, Diners, Apple Pay, G Pay, etc. and by allowing the billing of 15-25% of the transfer reservation (depending on the pick up area you choose) which will be charged to your credit or debit card, immediately via MT booking platform and you will pay the rest of the amount in Cash or via credit or debit card (if the Driver have that option) to the driver at the end of the ride or transfer.

MT uses Viva Payment Services Single Member S.A., Viva.com as a billing system that applies state-of-the-art data protection standards.

Viva Wallet complies with all PSD2 transaction security protocols, so as any customers’ payments remain secure in whichever Checkout solution one might select. Viva Wallet Smart Checkout, plugins and payment tools are fully PSD2-compliant, with 3DS being handled by the card issuers. With our PCI DSS Level 1 compliance status, we meet payment security standards and help protect customer data As a fully compliant PCI DSS Level 1 Service Provider and a principal member and licensed acquirer of Visa and MasterCard, Viva Wallet adhere to the card schemes’ operating regulations. We are also subject to yearly audits by a third-party PCI Qualified Security Assessor, Visa, MasterCard, and the banks we partner with. Tokenization is the process of replacing sensitive data with non-sensitive data. In the payments industry, it is used to safeguard a card’s PAN by replacing it with a unique string of numbers that cannot be used to make transactions.

Secure Socket Layer (SSL) protocol with 128-bit encryption and MD5 algorithm. The ISO 8583 protocol ensures that data exchange between the Viva.Com system and the credit card authorization centers is carried out on a private network, which is protected from the unauthorized access to a double layer of firewalls.

Directly upon the reservation, the User will receive an e-mail with exact data about the booked ride as well as the service price.

At the time of booking, User is obliged to fill in all the required information on the MT website correctly and truthfully. He or she will be liable for any other possible damages.

If you change your mind for any reason and want to cancel your transfer reservation, you have the option to do so within a maximum period of 120 h (5 days) from the reservation date, and in that case, you are entitled to a full refund of the reservation amount to your card. The same applies if MT is unable to provide a vehicle with a driver for the selected route and time, we will also refund the full reservation amount within a period of 120 h (5 days). In both cases, a written cancellation notice must be sent via email.

After the 120 h (5 days) period, we will consider the transfer reservation valid, and it will no longer be possible to cancel and receive a refund.

Two days (48 hours) before the agreed transfer, you will receive an email asking if everything is in order with the pick-up location and time.

After your response and confirmation of the same or any changes to the pick-up location and time, one day (24 hours) before, we will send you an email with detailed information about the vehicle and driver and a contact phone number for easier communication during pick-up.

 

TRANSPORT

Driving will be carried out with vehicles which, according to their characteristics, correspond to the booked ride. Any additional luggage which exceeds the usual amount of luggage consited of one big suitcase 28 inches (76 x 50 x 30 cm) or one medium suitcase 24 inches (67 x 45 x 27 cm) and one small suitcase 20 inches (56 x 39 x 23 cm) per person will be considered as additional traveler.

Vehicles are devided into several following categories:

  1. Economy sedan (max. 3 passengers)
  2. Luxury sedan (max. 3 passengers)
  3. MPV Monovolumen and SUV (max. 4 passengers)
  4. Economy Van (max. 8 passengers)
  5. Luxury Van Mercedes V Class (max. 7 passengers)
  6. Economy Minibus (max. 16 passengers)
  7. Ultra Luxury Limousines (max. 3 passengers)
  8. Ultra Luxury SUV (max. 4 passengers)
  9. Ultra Luxury Van Mercedes V Class (max. 5 passengers)
  10. Luxury Long Limousines and Oldtimer limousines for special events (2-14 passengers)
  11. Luxury VIP minibus Mercedes (max. 10 passengers)

By accepting the booking, the User grants the MT permission to forward the User’s information, the sole name, phone number and e-mail address to the Driver for a simple pick up. It is considered that the User has concluded a Carriage Agreement with the Driver when MT notifies the User of the name and details of the Driver. MT is not a party to such a contract. The Driver does not provide any additional services which are not related to the contracted transport services.

Users must be in a designated place at the agreed time. If the User does not appear within 30 minutes after the agreed time, the Driver may cancel the Service by leaving the agreed pick-up point. If the Driver does not appear within 30 minutes after the agreed time, the User will contact MT and notify the delay. If it is found that the Driver is unable to make the transport service, MT is obliged to provide other Driver under the same conditions as soon as possible. The User is not obliged to accept the option offered and can cancel the transport service by contacting MT. In this case, MT will cancel the reserved User’s funds and the Driver will compensate MT for costs and damages in accordance with the mutual agreement.

 

BEHAVIORAL POLICIES

Users must act reasonably and have good manners during travel, so as not to interfere with driving. Users must behave reasonably so as not to damage or contaminate the car. Drivers must act reasonably and kindly during the journey. While Drivers must work to reach the destination in the foreseeable time, Driver or MT does not give customers time-to-destination warranty. MT is not liable for any loss or damage incurred by the transport service.

 

USE OF THE SITE

Content and layout of the site is the intellectual property of MT and no one may use any part of the site without the prior written permission of MT. A website or any part of a web site may not be reproduced or otherwise used for any commercial purpose without the prior written consent of MT. No person has the right to systematically extract any part of the content on the Site without the prior written consent of MT. The site is intended exclusively for people over the age of 18. Any access to or use of the Site for persons under the age of 18 is expressly forbidden. By accessing or using the Website, the User presents and warrants that he or she is over the age of 18.

 

FEES

Drivers provide a transport service for the price stated in the booking confirmation. If the User, after confirming the booking, modifies the plan of the trip which is reflected in the price of the service, the User is obliged to re-confirm the reservation.

 

PRIVACY CONSENT

By submitting your name, contact information and any other personal data (Data) to MT or to the Driver through the Site or otherwise, you voluntarily agree that MT and the Driver use your information for completing the agreed driving service.

The protection of your privacy when using our website www.marintravel.hr is of utmost importance to us.
For the protection of personal data on this website, the trade company MARIN TRAVEL SLtd., Matka Baštijana 54, 10000 Zagreb, OIB: 90852815058 is responsible for the processing of personal data.

Your personal data is processed in accordance with the General Data Protection Regulation (EU Regulation 2016/679) and the Implementation Act of the General Data Protection Regulation (OG 42/2018) as well as with the Personal data protection policy of the trade company MARIN TRAVEL SLtd., Matka Baštijana 54, 10000 Zagreb, OIB: 90852815058 that can be found on the MT website www.marintravel.hr .

The personal data protection policy refers only to this website and it doesn’t refer to websites linked through this website or are visible on this website.

By accepting this personal data protection policy while ordering the ride trough this website you confirm that you have read, understood and you agree with the personal data processing determined by the MT Personal data protection policy.

In this way, you agree to receive marketing emails from MT. You can withdraw your consent to receive these emails by e-mail sent to marin.travel.agency@gmail.com or info@marintravel.hr . In particular, you may request MT and Driver to provide you with information on processing your data and you may ask MT and Driver to explain and remedy any inappropriate processing

MT is committed to provide personal data protection by collecting only the essential, basic information about the customers/users required to fulfill our obligations; informing buyers of how they use the data they collect, regularly gives customers the choice of using their data, including the ability to decide whether or not to remove their name from the lists used for marketing campaigns. All customer information is strictly kept and only accessible to employees who are required to do this. All MT employees and business partners are responsible for compliance with the privacy principles according to the MT Personal data protection policy.
